These Terms & Conditions (“Terms”) govern all bookings, services, retreats, experiences, and accommodation provided by Breathe (“we”, “us”, “our”), a UK-registered company operating in Tuscany, Italy.
By making a booking or participating in any service, you confirm that you have read, understood, and agree to these Terms.
1. Company Information
Breathe is a UK-registered business providing wellness retreats, accommodation, and experiences in Italy. Certain services are delivered in collaboration with local partners and properties in Tuscany.
2. Booking & Contract Formation
- All bookings are subject to availability and acceptance.
- A booking is confirmed only upon receipt of deposit or full payment (as specified at booking).
- A binding contract is formed once confirmation is issued.
- We reserve the right to refuse or cancel a booking prior to confirmation.
3. Prices & Payment
- Prices are listed in GBP (£) unless otherwise stated.
- We reserve the right to update pricing prior to booking confirmation.
- Payment terms (deposit amount, balance due dates) are specified at time of booking.
- Failure to pay balances by the due date may result in cancellation without refund of deposit.
4. Cancellation & Refund Policy
- All cancellations must be submitted in writing (email).
- Cancellation terms vary depending on the service (retreat, accommodation, or experience) and will be clearly stated at booking.
- Deposits are generally non-refundable unless otherwise specified.
- Refunds, where applicable, may be subject to administrative or processing fees.
- We strongly recommend comprehensive travel insurance covering cancellations, illness, and travel disruption.
5. Changes, Amendments & Cancellations by Us
We reserve the right to:
- Modify itineraries, activities, schedules, or accommodation where necessary
- Replace instructors, hosts, or venues with suitable alternatives
- Cancel or reschedule services due to low participation, safety concerns, or operational reasons
If we cancel a booking, you will be offered:
- A reschedule, or
- A refund of amounts paid (excluding non-recoverable third-party costs where applicable)
6. Accommodation (Check-in / Check-out / House Rules)
- Check-in and check-out times will be communicated in advance.
- Guests must respect agreed arrival and departure times.
- Late arrival must be communicated in advance and may be subject to limitations.
- Guests agree to comply with all house rules provided prior to or on arrival.
- The property must be left in a reasonable condition on departure.
Guests may be liable for additional cleaning or damage costs caused during their stay.
7. Guest Responsibilities
Guests agree to:
- Respect the property, staff, neighbours, and local community
- Use facilities responsibly and safely
- Immediately report any damage or issues
- Follow all instructions provided by staff or hosts
Guests are financially responsible for any damage caused by themselves or their party.
8. Retreats & Experiences (Participation & Risk)
- Participation is entirely voluntary.
- Guests accept that wellness activities (including movement, breathwork, hiking, or similar) involve inherent risks.
- Guests must ensure they are physically and mentally fit to participate.
- Any medical conditions, injuries, or limitations must be disclosed prior to participation.
- We reserve the right to restrict participation where safety may be compromised.
9. Health & Safety
- Guests are responsible for their own health, wellbeing, and fitness to participate.
- We are not medical professionals unless explicitly stated.
- We accept no liability for illness, injury, or adverse reactions except where caused by proven negligence.
10. Liability Limitation
To the fullest extent permitted by law:
- We are not liable for loss, theft, or damage to personal belongings.
- We are not responsible for indirect or consequential losses (including travel disruption or missed connections).
- We are not liable for events beyond our reasonable control, including but not limited to:
- Extreme weather
- Natural disasters
- Strikes or transport disruption
- Government restrictions
- Pandemics or public health events
Nothing in these Terms excludes liability for death or personal injury caused by negligence or fraud.
11. Force Majeure
We shall not be held liable for failure or delay in performance due to circumstances beyond our reasonable control. In such cases, services may be modified, postponed, or cancelled without liability beyond refund obligations where applicable.
12. Legal & Regulatory Compliance (Italy)
For services provided in Italy:
- Guests may be required to present valid identification upon arrival.
- Guest details may be registered with Italian authorities in compliance with local law (e.g. Alloggiati Web system).
- Local tourism, safety, and accommodation regulations apply.
13. Data Protection & Privacy
We process personal data in accordance with:
- UK GDPR
- EU GDPR (where applicable in Italy)
Personal data is used only for:
- Booking management
- Legal compliance
- Operational communication

14. Intellectual Property
All website content, branding, text, imagery, and materials are owned by or licensed to Breathe.
No content may be copied, reproduced, or distributed without prior written consent.
15. Third-Party Services
We may use or recommend third-party providers (e.g. transport, instructors, external venues). We are not responsible for the actions, omissions, or performance of third parties.
16. Website Use
Users agree not to misuse the website or attempt to disrupt its functionality. All content is provided for informational and booking purposes only.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
However, where services are delivered in Italy, mandatory provisions of Italian law and applicable EU consumer protection laws may apply.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer rights under applicable local law.
